The European Union’s regulation on artificial intelligence, administrative discretion and the reserve of humanity

Taking as a starting point the importance of the human-machine relationship and the current state of development of artificial intelligence (AI), the article focuses on the role of humans in limiting and supervising the operation of AI in relation to discretionary decisions made through a procedure of public administrative bodies and the potential complete automation of such decisions. The topic is that of human supervision, control or surveillance of the operation of the system, which has long been known in the technical literature as «human in the loop», or human in the system, in cases where the use of AI is accepted.
