Constitutional Transformation

This essay analyses the significance of the constitutional transformation that has deeply affected the history of the Italian Republic. The core of the transformation consists in the progressive rejection of the “political” conception of the Constitution, as a complex of principles to be enacted mainly through laws, in favour of an notion that privileges jurisdiction as the main instrument to materialize the constitutional principles.
